Terms of Service

1. Acceptance

By creating an account and using eMigration, you agree to these Terms of Service. If you are using eMigration on behalf of a firm, you represent that you have authority to bind the firm to these terms.

2. Service description

eMigration provides practice management software for Registered Migration Agents operating in Australia. The service is provided on a subscription basis with a 14-day free trial period.

3. Subscriptions and billing

• Subscriptions are billed monthly in Australian dollars (AUD) via Stripe.
• GST is charged in addition to the listed price where applicable.
• You may cancel at any time; cancellation takes effect at the end of the billing period.
• We reserve the right to change pricing with 30 days' written notice to active subscribers.

4. Acceptable use

You agree to use eMigration only for lawful purposes. You must not:

• Use the service for any purpose other than migration practice management
• Attempt to access data belonging to other firms
• Upload malicious files or attempt to compromise the platform
• Resell or sublicense access to the service

5. Your data

You retain ownership of all client and case data you store in eMigration. We process this data solely to provide the service. You are responsible for ensuring you have appropriate authority to store client information in the platform.

6. Service availability

We aim for 99.5% uptime but do not provide a formal SLA. We will provide reasonable notice of planned maintenance. We are not liable for losses arising from service unavailability.

7. Limitation of liability

To the maximum extent permitted by Australian law, our total liability to you for any claim arising from use of the service is limited to the fees paid by you in the three months preceding the claim.

8. Governing law

These terms are governed by the laws of Victoria, Australia. Disputes are subject to the exclusive jurisdiction of courts in Victoria.
